Website Terms, Privacy Policy and Social Media Guidelines

The Concussion Awareness Now website and its contents are the property of the Concussion Awareness Now Coalition (CAN). This web page states the website terms, privacy policy, and social media guidelines for use of the website, concussionawarenessnow.org (referred as the “website terms”), which is administered by the Brain Injury Association of America.  The primary purpose of this website is to provide information on the definition of concussion, common symptoms, action steps and more. Our audience includes all individuals who may be at risk of sustaining a concussion, i.e., the general public.

By using this website, you agree to be bound by these website terms. If you do not wish to be bound by these Terms, do not use the website. 

Trademarks and Logos

CAN is supported by the Brain Injury Association of America and Abbott. User agrees not to use the name Concussion Awareness Now, the Concussion Awareness Now Coalition, the Brain Injury Association of America, BIAA, Abbott or their logos for any promotional or commercial purpose or any other purpose without the prior written consent of the Concussion Awareness Now Coalition and the respective name and logo owners.

Copyright and Reprint Permissions

Concussion Awareness Now (CAN) retains copyright on the content of this website, including the text, graphics, images, logos, icons, HTML code and other materials (“website content”) unless otherwise noted. User agrees not to remove or obscure copyright notices appearing on the website or website content. CAN grants no copyright or ownership interests to User for any of the website content and proprietary information referred to herein belonging to CAN; limited use of the website content is permitted only as expressly stated in the terms below. Permission to use the website content may be granted on a case-by-case basis. Please direct any request to use website content to: info@concussionawarnessnow.org.

Permitted Uses of Website Content

  1. Anyone who is doing personal, non-commercial research may view, print and distribute the website content, provided that the use of the website content does not conflict with any of the prohibited uses below. 
  2. User cannot remove CAN’s copyright notice from the website content. If no copyright notice is displayed, use of CAN website content must acknowledge Concussion Awareness Now’s copyright.
  3. Anyone may share website content by utilizing the “share” icons displayed in conjunction with the content.  
  4. CAN may grant open access license to users for selected website content, and Users will be bound by such open access license terms. 
  5. Any use other than as described in paragraph 1 ~ 4 above requires prior written permission from Association. Please direct any request by emailing info@concussionawarnessnow.org.

Prohibited Uses of Website Content

  1. Except for the permitted uses above, User agrees not to reproduce, distribute, transmit (via print, fax, electronic, or other means), modify, alter or create derivative works of the website content without prior written permission from CAN.
  2. No graphic elements on any page or document on this website may be used, copied, or distributed separate from the accompanying text
  3. User agrees that the website content may not be commercially exploited or sold to third parties without prior written authorization from CAN.
  4. User agrees that website content may not be systematically stored on a server so as to substitute for the purchase of a subscription and/or license agreement to/for the materials.

Links

Third parties may establish a link to any portion of Concussion Awareness Now’s website with the acknowledgement that all content is subject to revision or removal. In general, Concussion Awareness Now does not accept unsolicited requests to link to external sites. Where an external link is provided, Concussion Awareness Now is not responsible for the information or advice provided on the external site and does not make any representations regarding the content or accuracy of materials on such third-party websites.

CAN works to ensure that the information provided on this site is accurate, timely and useful. However, the information contained on the website could include technical inaccuracies or typographical errors and should not be considered medical guidance. The members of the Concussion Awareness Now Coalition and any other parties involved in the preparation or publication of this site are not responsible for errors or omissions in information or any actions resulting from the use of such information. Visitors are encouraged to confirm the information contained here and to direct any questions concerning their personal health to licensed health care professionals.

User may be able to voluntarily post content and information to the website. By voluntarily providing or posting information on the website, User grants a non-exclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicenseable, fully paid up and royalty-free right to Concussion Awareness Now Coalition the right to use and commercialize, in any way now known or in the future discovered, anything that you submit to Concussion Awareness Now, without further consent, notice and/or compensation to User or any third parties. In addition, by voluntarily posting information on the website, User grants any other user the right to access, display, view, store and reproduce this material according to the “Permitted Uses of Website Content” provision of these Terms. 

By submitting any information to Concussion Awareness Now, you represent and warrant that the submission is accurate to your best knowledge, not confidential, and not in violation of any contractual restrictions or other third party proprietary or privacy rights. Concussion Awareness Now does not represent or guarantee the truthfulness, accuracy or reliability of communications posted by users or endorses any opinions expressed by users. User acknowledges that any reliance on material posted by other users will be at your own risk.  Concussion Awareness Now is under no obligation to exercise control over any content you or others submit when using the website.

Social Media Guidelines

The website includes social media features, such as the Facebook and Instagram buttons, that run on the CAN website. These features may collect your Internet Protocol address and which page you are visiting on our website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the website. Your interactions with these features are governed by the privacy policy of the company providing it.

If you participate in Concussion Awareness Now’s social media channels platforms, User must agree to abide by the social media guidelines: 

  • In order to preserve a climate that encourages both civil and fruitful dialogue, CAN reserves the right to delete posts and to suspend or terminate the right of any participation for any reason without notice.   • CAN is not responsible for the content of third party social media websites and does not make any representations regarding the content or accuracy of materials on them. Concussion Awareness Now is committed to protecting the privacy of its website visitors. Any information CAN collects serve to further the purpose of this website—to provide information on the definition of concussion, common symptoms, action steps and more.  Pleas review this Security and Privacy provision before using the website or submitting information to CAN through the website. 

Web Server Information

When Users visit the website, Concussion Awareness Now collects certain information automatically that may not identify you personally: 

  • Internet Protocol (IP) address. An IP address is a number that is automatically assigned to the computer you are using whenever you access the Internet.

  • The pages on the CAN website that you access

Personal Information Voluntarily Submitted to CAN

Users can access the website without submitting any information to CAN. However, if you wish to access additional content available on this website or participate in some of CAN’s activities, we may ask that you provide us personally identifiable information. The types of personal data we collect vary based on the programs, services and products you wish to engage in. For example, we may collect name, e-mail addresses and other personal information when you provide it to us when requesting information from us, responding to a survey or opinion poll or completing an electronic transaction. 

We do not sell, trade or rent your personal information to third party processors for their promotional or marketing purposes unless you provide consent. Notwithstanding the foregoing, CAN may disclose your personal information as required by law or as needed in legal proceedings when CAN believes in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request. 

In addition, in the event of a merger, acquisition, or any form of sale or transfer of some or all of our assets to a third party, we may also disclose your personal information to the third parties concerned or their professional advisors. In the event of such a transaction, the personal information held by CAN will be among the assets subject to the transaction.

Concussion Awareness Now (CAN) supports the protection of intellectual property. CAN has established the following policies for considering copyright infringement claims.

Digital Millennium Copyright Act Notification

To notify CAN of a claimed copyright infringement, a notification of a claimed copyright infringement must be provided to CAN via e-mail and must include the following information:

  1. The subject line of the e-mail must include the words “Copyright Infringement Claim.”
  2. An electronic signature of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive copyright that has allegedly been infringed.
  3. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works on that site.
  4. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit CAN to locate the material.
  5. Information reasonably sufficient to permit CAN to contact the Complaining Party, such as an address, telephone number, and, if available, an electronic mail address at which the Complaining Party may be contacted.
  6. A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  7. A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is the owner, or is authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

If CAN concludes that the Complaining Party has raised a legitimate copyright claim, it will remove or deny access to the allegedly infringing material from the CAN website.
